    Need help with HIPAA laws

    Hi, we will be starting eMDs in our office in next couple months. Also plan to use a camera to capture any lesion etc ( I am Int Med); which can be incorporated into the EMR. This is the first time doing so. My question is..

    Where can I get the rules pertaining to the medical images of the patient?

    Generally speaking, the same rules that apply to the rest of the patient records, don't post videos or photos online with any of the 18 PHI elements

    Any forms (for HIPAA compliance) that need to be offered before such images are stored in the patient's EMR...???

    A consent for photography should be signed, dated, and timed, and scanned into the record. Not a HIPAA thing, but a legal thing.

    Most HIPAA release forms include everything as releasable except HIV and mental health records, unless specifically stated.
